What is Criminal Law?

Attorney Márquez’s passion for criminal defense started in law school where he practiced as a student attorney.

Later he developed a passion to have an even bigger impact on people's lives by practicing family law. Now he enjoys doing them both and has developed an expertise when representing people who are engaged in criminal and family law cases at the same time. A criminal case can have a massive impact on a parental responsibilities case and vice versa. A criminal attorney may have a very different agenda than a family law attorney, so engaging someone who does both can be both very strategic and far more efficient.

The firm represents defendants in all kinds of misdemeanor cases including but not limited to

traffic cases like Driving Under the Influence, assault, harassment, and theft. In addition, the firm represents defendants in some felonies, especially those that involve domestic violence such as 2nd degree assault and menacing. 

 

Many defendants do not believe that engaging an attorney can have a substantial impact on the outcome of their criminal case, especially when it comes to DUIs and traffic-related offenses. That is where Márquez Law stands apart. While most defense attorneys are focused on winning trials and negotiating the best plea agreements, the firm is primarily focused on helping those involved in a criminal case start over and move on after their case is over. This can include not just helping a client stay sober during a DUI case, but ensuring that the Client deals with any substance abuse issue to avoid recidivism and collateral consequences in their lives and possibly family law cases. This means that while the firm will work very hard to achieve the best possible results, the firm will expect a client to work hard to learn from his/her mistakes and become a better person.

Because public defenders often have overwhelming caseloads, defendants may not believe such attorneys have the compassion or commitment to prioritize the client’s goals. Furthermore, while many people do not qualify for the public defender (essentially if you are working you will not qualify), they lack the resources to hire private counsel. The firm has attempted to resolve this dilemma, as least in part. The firm will generally offer a flat fee arrangement so that the client’s rights never suffer as a result of the amount of work or number of court appearances that may be required. While the firm does not believe that a client should choose a plea bargain simply because he/she cannot afford a jury trial, the firm will usually offer a flat fee in two stages. The first stage is through deposition that may include dismissal, plea bargain, motions hearing, or other outcomes short of a trial. The second stage includes a trial. The fee for the second stage is usually not paid until the trial is scheduled, which gives the defendant the ability to spread the cost of their defense over time.

Typically speaking, first time offenders and clear-cut cases are the least costly. Cases involving multiple offenders or defendants who need the most help in and out of court will be the most costly. You do not just want an outstanding negotiator by your side, you want a seasoned litigator to take you all the way when appropriate.
